The Digitalisation of Music Video Broadcasting Authorisation
As part of the Cape Advanced TV and Fastrax platform in partnership with Yacast / Muzicenter, the provision of music videos to music channels is fully digital.
Previously, providing a music video required a physical or scanned document called a 'specific supply contract' to act as a broadcasting authorisation. This process is now completely digitalised. There is no longer a need to upload a written contract to the platform. Instead, the act of delivering music videos via our services automatically counts as a digitised signature and broadcasting authorisation.
This streamlined system allows for:
- The reduction of errors
- The reduction of time spent at all stages of the supply and broadcasting authorisation process
- The simplification and acceleration of declarative formalities
The Legal Framework
Each channel has entered into a 'general agreement of common interest' with the Civil Societies (SCPP, SPPF), which defines the general conditions for broadcasting music videos. Historically, this required an appendix—a 'specific music video supply contract'—to be signed by both the label and the channel for each music video supplied.
This 'general agreement of common interest' now includes provisions for the digitalised supply of music videos, legally formalising this new workflow without the need for a manually signed document.
The updated terms of service for Yacast / Muzicenter and Cape Advanced TV ensure that:
- The delivery of a music video by the label constitutes full authorisation for broadcasting by the targeted channels. This replaces the specific supply contract, provided the channel complies with the general conditions of access and usage.
- The acknowledgment of receipt of the music video by the channel in the Cape Advanced TV platform constitutes acceptance of this broadcasting authorisation.
How does it work for labels?
The only formality for the label is to accept the updated general terms of service of the Yacast / Muzicenter service, which formalises these legal principles. It is crucial to ensure that the ISRC number provided accurately corresponds to each music video authorised for broadcasting.
How does it work for music channels?
The channel signs the updated general terms of service for the Cape Advanced TV service, which reflect these legal principles.
The channel also signs an amendment to their 'general agreement of common interest' with the SCPP and SPPF, formalising the digitalisation of this broadcasting authorisation process and their acceptance of it.
How does it work for data flows?
When the channel acknowledges the receipt of music videos in Cape Advanced TV, this automatically triggers a data flow sent to the relevant Civil Society. This data flow contains:
- Data related to the music video: identification of the relevant video, label, rights holders, ISRC, and other relevant information (e.g., product placement details).
- Data related to the delivery: reference and timestamp of the delivery (= broadcasting authorisation).
- Data related to the acknowledgment of receipt: identification of the channel, reference, and timestamp of the acknowledgment (= acceptance of the authorisation).
